1. About Us & Our Platform

Adriatic Motion operates an online catalog and booking inquiry platform that connects customers ("Renters") with independent third-party operators, professional hosts, and local businesses ("Operators") who provide rentals for boats, planes, jet skis, bicycles, and other recreational vehicles or equipment.
Adriatic Motion does not own, operate, manage, or maintain any of the vehicles, aircraft, watercraft, or equipment displayed on the website, nor do we act as an insurer. The rental agreement and service delivery take place exclusively between the Renter and the Operator.

2. Information Displayed on the Site

All specifications, listings, availabilities, images, and descriptions displayed on Adriatic Motion are provided directly by the respective Operators to be managed within our Content Management System (CMS).

While we endeavor to ensure the site is accurate, Adriatic Motion does not physically inspect the vehicles or verify the real-time accuracy of information supplied by Operators.
We do not guarantee, certify, or endorse the mechanical safety, legal compliance, or technical condition of any vehicle or equipment listed.

3. Licenses, Qualifications & Document Verification

It is the sole responsibility of the Renter to hold all valid, legal certificates, driver's licenses, skipper licenses, or pilot permits required by local law to operate the booked vehicle or equipment.

The Operator is solely responsible for physically inspecting and verifying the Renter’s original licenses, qualifications, and matching identification on the day of the rental handover.
If a rental cannot proceed because the Renter failed to provide the necessary legal paperwork at the dock/field, any funds paid directly to the Operator remain subject to the Operator's terms.

4. Payments, Cancellations & Refunds

Adriatic Motion is strictly an informational listing and inquiry platform; we do not process, collect, or hold any payments, reservation fees, or deposits from Renters on our website.

Direct Transactions: To secure a booking, all payments (deposits, balances, and security deposits) must be paid by the Renter directly to the Operator’s bank account (IBAN) or via the Operator's accepted payment methods.
Operator Cancellation Policies: Because all funds go straight to the Operator, any cancellation by a Renter, change of plans, or weather-related issue is subject exclusively to that specific Operator’s commercial refund policy.
No Platform Refunds: Adriatic Motion does not possess your funds, cannot execute bank transfers, and cannot process chargebacks. All requests for refunds, deposit returns, or financial resolutions must be settled directly with the Operator.

5. Cancellations by the Operator

If an Operator cancels a scheduled booking due to a mechanical breakdown, double-booking, or availability error, the direct agreement between the Renter and Operator is voided.

Operator’s Legal Obligation: The Operator is solely and legally responsible for returning any down payments or reservation balances directly back to the Renter’s bank account.
Dispute Disclaimer: Adriatic Motion assumes no responsibility or liability for an Operator's failure to return funds. Any financial or legal disputes regarding unreturned deposits following an Operator cancellation must be resolved exclusively between the Renter and the Operator.

6. Weather & Operational Policy

Recreational, maritime, and aviation activities carry inherent environmental risks. Adriatic Motion does not issue refunds for bad weather. In the event of extreme weather or official regulatory safety bans that legally prohibit the safe operation of the vehicle/aircraft on your scheduled date, the Renter must deal directly with the Operator regarding their specific commercial policies for rescheduling or makeup dates.

7. Strict Limitation of Liability

Adriatic Motion acts solely as an intermediary booking platform. To the maximum extent permitted by applicable law:

We are not liable for the conduct, safety, quality, actions, omissions, or negligence of any Renter or Operator.
We are not a party to any direct rental contracts, insurance disputes, vehicle damage claims, or security deposit disagreements; all such conflicts must be settled directly between the Renter and the Operator.
Adriatic Motion disclaims all liability for any personal injury, property damage, loss of life, or financial loss arising out of or related to the use of any vehicle, aircraft, or equipment booked through our website.

8. EU Consumer Rights

For residents of the European Union, nothing in these terms limits or overrides your mandatory statutory consumer protection rights under EU law. Where any provision of these Terms conflicts with mandatory statutory local laws, your statutory consumer rights take precedence.

9. Governing Law & Jurisdiction

These Terms and all interactions with Adriatic Motion are governed exclusively by the laws of the Republic of Croatia. Any legal disputes arising from the use of our platform shall be subject to the exclusive jurisdiction of the competent Croatian courts.
